By creating an account on zubaLoan or applying for a loan, you confirm that you have read, understood, and agreed to these Terms of Service and our Privacy Policy. If you do not agree, do not use our Service.
1. Acceptance of Terms
These Terms of Service ("Terms") are entered into between you ("User", "Borrower", "you") and LUVA TECH INTERNATIONAL LIMITED (D-U-N-S Number: 850394761), a company incorporated and operating at Tsavo Building, Tsavo Road, Starehe District Nairobi, Nairobi, Kenya ("Company", "we", "us", "our").
By accessing or using the zubaLoan mobile application ("App"), website ("Site"), or any associated services ("Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. These Terms apply to all visitors, users, applicants, and borrowers.
These Terms constitute a legally binding agreement. If you are using the Service on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms.
2. Eligibility Requirements
To be eligible to register for and use zubaLoan services, you must meet all of the following criteria at the time of application and throughout the loan term:
- Be a citizen or legal resident of Uganda, aged 18 years or older.
- Hold a valid Ugandan National Identity Card (NIN) or equivalent government-issued photo identification.
- Have an active mobile money account with MTN Uganda (MoMo) or Airtel Uganda (Airtel Money) in your own name.
- Own or have regular access to a smartphone capable of running the zubaLoan App (Android 5.0+ or iOS 12+).
- Have a valid mobile phone number registered in your name in Uganda.
- Not be bankrupt, insolvent, or subject to any legal restrictions that would prevent you from entering into financial agreements.
- Not have any existing overdue or defaulted loan with zubaLoan or any outstanding misrepresentation within our system.
We reserve the right to verify your eligibility at any time and to reject applications that do not meet these criteria.
3. Account Registration & Security
3.1 Registration
To use our Services, you must create a zubaLoan account. During registration, you agree to:
- Provide accurate, current, and complete information as prompted by the registration process.
- Submit genuine identity documents and not impersonate any person or entity.
- Maintain and promptly update your account information to keep it accurate and current.
- Provide a valid mobile number and mobile money account number.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account login credentials, PIN, and device. You must:
- Not share your account password or PIN with any third party, including zubaLoan staff.
- Immediately notify us at support@zubaloan.com or call +256 700 000 000 if you suspect unauthorized access to your account.
- Log out of your account on shared devices.
You are fully responsible for all activities and loan applications made through your account. We are not liable for losses resulting from unauthorized access caused by your failure to maintain account security.
3.3 One Account Per Person
Each individual may maintain only one (1) zubaLoan account. Creating multiple accounts to circumvent credit limits, defaulted loans, or any restrictions is strictly prohibited and constitutes fraud.
4. Loan Services
4.1 Loan Application
When you submit a loan application through the App, you authorize us to:
- Access and process your personal and financial information for credit assessment purposes.
- Obtain your credit history from licensed credit bureaus in Uganda.
- Use your mobile device data and usage patterns (with your consent) to inform our credit scoring model.
- Contact your designated emergency contact for verification or collection purposes if necessary.
4.2 Loan Approval
Loan applications are subject to our credit assessment process. We reserve the right to:
- Approve or decline any application at our sole discretion without being required to give reasons.
- Offer a lower loan amount or different terms than requested.
- Require additional documentation or verification before approval.
4.3 Loan Agreement
Upon approval, you will be presented with a Loan Agreement detailing the approved amount, tenure, total repayment amount, fees, and due dates. By tapping "Accept" or the equivalent confirmation button, you:
- Enter into a legally binding Loan Agreement with the Company.
- Confirm that you have read and understood all loan terms.
- Agree to repay the total amount as specified on or before the due date(s).
4.4 Disbursement
Approved loan funds will be disbursed directly to your registered MTN MoMo or Airtel Money account. You agree that disbursement to such account constitutes valid delivery of the loan funds. We are not responsible for delays caused by mobile money network issues outside our control.
5. Interest Rates, Fees & Charges
5.1 Transparency
All applicable interest rates, processing fees, and charges will be clearly displayed in the App before you accept any loan. By accepting a loan, you confirm you understand and agree to all applicable charges.
5.2 Interest Rate
Interest rates vary based on your loan product, credit profile, loan amount, and tenure. Rates are expressed as monthly rates and are disclosed in the Loan Agreement. zubaLoan does not engage in deceptive pricing — the total repayment amount shown at acceptance is the maximum you will owe (subject to any late fees as described below).
5.3 Processing Fees
A one-time processing or service fee may be charged per loan. This fee, if applicable, will be displayed before acceptance and is deducted from or added to your loan amount as specified in the Loan Agreement.
5.4 Late Payment Fees
If you fail to make full repayment by the due date, a late payment fee will be applied to the outstanding balance for each day the payment is overdue. The applicable daily rate will be stated in your Loan Agreement. Late fees are designed to recover costs and are not intended as penalties.
5.5 Early Repayment
You may repay your loan in full at any time before the due date. We do not charge early repayment penalties. If you repay early, you will only be charged interest for the period the loan was outstanding.
6. Repayment Obligations
6.1 Repayment Method
All loan repayments must be made through the zubaLoan App using MTN MoMo or Airtel Money. Payments must be made in Ugandan Shillings (UGX). We do not accept cash payments.
6.2 Due Dates
You are responsible for ensuring repayment is completed by the due date specified in your Loan Agreement. Receiving payment reminders from us is a courtesy service — the absence of a reminder does not excuse a late payment.
6.3 Partial Payments
If you cannot repay the full outstanding balance on time, partial payments are accepted. However, the unpaid balance will continue to accrue late fees. We encourage you to contact our support team proactively if you anticipate difficulty repaying, as we may be able to discuss repayment options.
6.4 Payment Confirmation
A repayment is only confirmed when it appears as received in the App. Technical delays on the mobile money network may cause processing delays. Retain your mobile money transaction confirmation codes as proof of payment.
7. Default & Consequences
7.1 Events of Default
You are considered to be in default if:
- You fail to make any repayment on or before the due date.
- You have provided materially false or misleading information in your application.
- You have created multiple accounts to circumvent loan limits or repayment obligations.
- Any other event occurs that, in our reasonable judgement, materially impairs your ability or willingness to repay.
7.2 Consequences of Default
Upon default, the Company may take any or all of the following actions:
- Declare the entire outstanding loan balance (principal + interest + accumulated late fees) immediately due and payable.
- Report the default to one or more licensed credit bureaus in Uganda, which may negatively affect your ability to obtain credit from other lenders.
- Engage licensed debt collection agencies to recover the outstanding balance. You may be liable for reasonable collection costs incurred.
- Take legal action against you in the courts of Uganda to recover the debt.
- Suspend or permanently terminate your zubaLoan account.
- Contact your designated emergency contact person for the purpose of debt collection.
We encourage responsible borrowing. If you face financial difficulty, please contact us before your due date to discuss your situation.
8. User Conduct & Prohibited Activities
By using zubaLoan, you agree not to:
- Provide false, inaccurate, or misleading information at any stage of the loan application or account maintenance process.
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- Attempt to access another user's account without authorization.
- Use bots, scripts, or other automated methods to interact with the App or submit loan applications.
- Reverse-engineer, decompile, or otherwise attempt to derive the source code of the App.
- Interfere with, disrupt, or disable the security or functionality of the Service.
- Use loan proceeds for any illegal activity, including but not limited to money laundering, terrorist financing, or drug trafficking.
- Share, publish, or distribute confidential information about our business, technology, or other users.
Violation of these conduct rules may result in immediate account suspension, legal action, and reporting to appropriate law enforcement authorities.
9. Intellectual Property
The zubaLoan name, logo, App design, website content, software, and all associated intellectual property are the exclusive property of LUVA TECH INTERNATIONAL LIMITED and are protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on your personal device solely for the purpose of accessing our Services in accordance with these Terms. You may not copy, modify, distribute, sell, sublicense, or create derivative works from our intellectual property without our express written consent.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE SERVICE.
We do not warrant that the App will be available at all times, free of viruses or other harmful components, or that errors will be corrected. We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LUVA TECH INTERNATIONAL LIMITED, ITS DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM:
- Your use of or inability to use the Service.
- Any unauthorized access to your account due to your failure to maintain security.
- Delays or failures in loan disbursement due to third-party mobile money network issues.
- Any content or services accessed through links on our website.
Our total liability to you for any claim arising from or related to these Terms or the Service shall not exceed the total fees you paid to us in the three (3) months preceding the event giving rise to the claim.
Nothing in these Terms limits our liability for fraud, gross negligence, or matters that cannot be limited by law.
12. Indemnification
You agree to defend, indemnify, and hold harmless LUVA TECH INTERNATIONAL LIMITED and its officers, directors, employees, agents, and partners from any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from:
- Your use of the Service or any violation of these Terms.
- Your submission of false or misleading information in connection with a loan application.
- Any infringement by you of any third party's rights.
- Any claim by a third party arising from your use of funds received through zubaLoan.
13. Termination
13.1 Termination by You
You may close your zubaLoan account at any time by contacting our support team, provided that all outstanding loan balances, interest, and fees have been fully repaid. Account closure does not affect any obligations that have arisen before termination.
13.2 Termination by Us
We may suspend or terminate your account, with or without notice, for any of the following reasons:
- Violation of these Terms of Service.
- Fraudulent or illegal activity.
- Providing false information during registration or application.
- Non-payment of outstanding loan obligations.
- For any other reason at our sole discretion.
13.3 Effect of Termination
Upon termination, your right to use the Service will cease immediately. All outstanding loan obligations remain valid and enforceable. Sections 7, 9, 10, 11, 12, 14, and 15 of these Terms survive termination.
14. Dispute Resolution
14.1 Informal Resolution
Before initiating any formal legal proceedings, you agree to first contact us at support@zubaloan.com to attempt to resolve any dispute informally. We will make good-faith efforts to address your concerns within 30 days.
14.2 Formal Dispute Process
If informal resolution fails, you may submit a formal complaint in writing to:
14.3 Arbitration
Any unresolved dispute arising from or relating to these Terms or the Service shall be settled by binding arbitration conducted in Nairobi, Kenya, under the rules of the Chartered Institute of Arbitrators (Kenya Branch), unless both parties agree otherwise. The arbitration shall be conducted in English. The decision of the arbitrator shall be final and binding on both parties.
15. Governing Law & Jurisdiction
These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of Kenya, without regard to its conflict of law principles. For matters relating specifically to loan services rendered in Uganda, applicable Ugandan financial services regulations shall also apply.
Subject to Section 14 (Arbitration), any legal proceedings not subject to arbitration shall be brought exclusively in the courts of Nairobi, Kenya, and you consent to the personal jurisdiction of such courts.
16. Amendments to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will:
- Update the "Last Updated" date at the top of this page.
- Provide at least 14 days' advance notice of material changes via in-app notification, SMS, or email.
Your continued use of the Service after the effective date of changes constitutes your acceptance of the updated Terms. If you do not accept the changes, you must stop using the Service and, if you have an outstanding loan, contact us to discuss your obligations.
